Introduction

These General Terms and Conditions of Sale (GTCS) are offered by the company Passion Parfum, registered under SIRET number 10359329900011, whose registered office is at 26 Rue de la grande Briere, 78180 Montigny le Bretonneux, France.
Passion Parfum operates the website https://passion-parfum.com, which offers cosmetics and perfumery products for sale.
The purpose of these GTCS is to define the rights and obligations of Passion Parfum and its customers, exclusively private individuals, in connection with the sale of the products presented on the website. Any order placed on the website implies the customer's unreserved acceptance of these GTCS.

Order and Conclusion of the Contract

  1. Ordering Process:
    Customers of the website https://passion-parfum.com may place an order by creating an account or as guests.
    The ordering process follows these steps:

    • The customer selects the products they wish to buy and adds them to their basket.
    • They then confirm the delivery and billing details.
    • The customer pays for their order using the payment methods offered on the website.
    • Once payment is confirmed, an order confirmation is sent by email, and a confirmation page is displayed on the website.

  2. Order Confirmation:
    After payment has been validated, Passion Parfum will send an order confirmation by email to the address provided by the customer. This confirmation will summarise the products ordered, the delivery details and the total amount paid.
    The contract of sale is deemed concluded from the moment Passion Parfum confirms the order by email.

  3. Cancellation or Modification of the Order:
    Once the order has been confirmed, it can no longer be cancelled or modified by the customer. However, in the event of a problem or an error in the order, the customer is invited to contact Passion Parfum's customer service promptly to consider a solution.

Prices and Payment Terms

  1. Display of Prices:
    All prices of the products offered on the website https://passion-parfum.com are stated in euros and inclusive of all taxes, in accordance with the legislation in force.
    Delivery charges are not included in the price of the products. They are added when the order is confirmed and vary according to the shipping method chosen by the customer. The total amount payable, including delivery charges, will be shown before the final confirmation of the order.

  2. Payment Methods:
    Passion Parfum accepts the following payment methods:

    • Bank card (Visa, MasterCard, etc.)
    • PayPal

  3. Payment Deadline and Validation:
    Payment is due at the time of the order. No order will be dispatched until payment has been received in full by Passion Parfum.
    In addition to immediate payments, the customer may make a deferred payment or pay in instalments through PayPal, subject to the specific conditions offered by PayPal when this payment method is selected.

Delivery and Lead Times

  1. Delivery Areas:
    Passion Parfum delivers worldwide. The specific conditions applicable to shipments outside the European Union are set out in point 6 below.

  2. Delivery Times:
    Delivery times are estimated as follows:

    • France: between 3 and 5 working days.
    • Other European Union countries: up to 7 working days.
    • Rest of the world: up to 15 working days, depending on the destination and customs formalities.
      Delivery times are given as an indication and may vary depending on carrier availability or exceptional circumstances.

  3. Shipping Methods:
    Orders are dispatched via the following carriers:

    • La Poste (Colissimo)
    • UPS
    • Mondial Relay
      The choice of carrier is offered to the customer when the order is confirmed.

  4. Delivery Charges:
    Delivery charges vary according to the quantity of products ordered, the weight of the order and the place of delivery. These charges will be calculated and shown before the customer's final confirmation of the order.

  5. Delivery Delay:
    In the event of a delay in delivery, Passion Parfum undertakes to find an amicable solution with the customer. This solution may be financial (partial refund) or take the form of a credit note valid on the website. The customer is invited to contact customer service in the event of a delivery problem.

  6. Shipments outside Europe:
    For shipments to countries outside the European Union, Passion Parfum cannot be held liable for losses, damage to parcels or delays occurring during international transport.
    Any order shipped outside Europe is under the customer's responsibility from the moment it is handed over to the carrier.
    No compensation, replacement or refund can be granted in the event of loss, theft, damage or customs blocking.

Withdrawal and Returns

  1. Right of Withdrawal:
    In accordance with the legal provisions in force, Passion Parfum customers have a period of 14 days from receipt of their order to exercise their right of withdrawal, without having to give reasons or pay penalties.
    However, this right of withdrawal applies only if the returned products are in their original packaging, unopened and unused, in particular for perfumery and cosmetic products, for reasons of hygiene and safety.

  2. Withdrawal Procedure:
    To exercise their right of withdrawal, customers must send their request by email to the following address: contact@passion-parfum.com.
    Products must be returned to the address indicated by Passion Parfum, and return costs are borne by the customer. The product must be returned in its original condition, complete, and properly packaged to avoid any damage during transport.

  3. Refund:
    Once the products have been returned and received by Passion Parfum, a check will be carried out to verify their conformity. The refund will then be made within a maximum of 14 days from receipt of the returned products.
    At the customer's choice, the refund may take the form of a credit note valid on the website https://passion-parfum.com, or of a repayment of the amount paid on the original order, via the same payment method used by the customer.

Warranty and Liability

  1. Legal Warranty:
    All products sold on https://passion-parfum.com benefit from the legal warranty of conformity and the warranty against hidden defects, in accordance with articles L217-4 et seq. of the French Consumer Code and articles 1641 et seq. of the French Civil Code.
    These warranties apply for a period of 2 years from receipt of the product by the customer.

  2. Non-conformity of Products:
    If a delivered product is defective or does not conform to the order, the customer must inform Passion Parfum by sending an email to contact@passion-parfum.com, specifying the details of the problem encountered.
    Depending on the case, Passion Parfum will offer a replacement, a repair or a refund of the product concerned, subject to verification of the non-conformity or defect of the product.

  3. Limitation of Liability:
    Passion Parfum cannot be held liable in the event of misuse or incorrect handling of the product by the customer, or in the event of damage deemed accidental caused by the user. In such cases, the warranty may not apply.

Protection of Personal Data

  1. Data Collected:
    As part of its sales activity on https://passion-parfum.com, Passion Parfum collects the following personal data:

    • Surname and first name
    • Postal address
    • Email address
    • Payment information
      This data is essential for processing orders and managing the commercial relationship with the customer.

Applicable Law and Disputes

These General Terms and Conditions of Sale are governed by French law. In the event of a dispute relating to the interpretation or performance of these GTCS, the parties will endeavour to find an amicable solution.

If no amicable solution can be found, the dispute will be submitted to the exclusive jurisdiction of the French courts, in accordance with the provisions of the French Code of Civil Procedure.
The customer is also informed that they may, if they wish, have recourse to conventional mediation or any other alternative dispute resolution method, in accordance with articles L611-1 et seq. of the French Consumer Code.

Force Majeure

Passion Parfum cannot be held liable for the non-performance of its contractual obligations under these General Terms and Conditions of Sale in the event of a force majeure event.

Force majeure events are all unforeseeable, irresistible events beyond the control of the parties, as defined by French legislation and case law, including but not limited to: natural disasters, fires, bad weather, strikes, wars, acts of terrorism, pandemics, or any other circumstance making it impossible for the seller to perform its obligations.

In the event of force majeure, the performance of Passion Parfum's obligations will be suspended for the duration of the event. Should it last more than 30 days, either party may cancel the order concerned, without compensation.
